1Introduction
MESCLA is a game developed by Onrizon Social Games (“Onrizon”, “we” or “us”). These Terms set out the conditions for using the app on iOS and Android devices. For questions, support and requests, contact us at team@gartic.com.
2How to play
MESCLA is a group game in which each participant follows their own color and interacts with the devices' screens according to the rules of the chosen mode. Each participant must open the app on a compatible device and join the same room.
You don't need to create an account to play MESCLA. The devices sync with one another, with the device that sets up the room, called the host, acting as the central point of the match.
You need a compatible device and the connection conditions indicated in the app. A match's performance depends on the devices, the host and the connection used. Closing the app or losing the connection on one of the devices may interrupt your participation or affect the match.
Invite the people you want to play with. Sharing the code, or any other means of access to the room, allows other people to try to join. Joining a room does not grant access to other apps, files or private information on the devices.
3Free and Full versions
The Free version lets you play the Rush mode in rooms of up to 7 players.
The Full version includes the Rush mode, adds the Echo, Hold and Duel modes, and allows rooms of up to 12 players.
The modes work as follows, as detailed in the app's instructions:
- Rush: tap your color when it appears and compete for the highest score.
- Echo: follow your color's path across the devices and repeat the sequence.
- Hold: keep your color pressed for the indicated time, adding to the group's score.
- Duel: compete for the fastest reaction when the colors appear.
Only the person who creates the room needs to purchase Full to make its features available in that room. The other participants can join using the Free version, subject to the room's limit and the technical requirements. Joining a Full room does not grant you your own Full license to create other rooms.
4Purchasing Full
Full is acquired through a one-time purchase. It is not a subscription, and this purchase does not renew periodically.
The purchase is made through the App Store or Google Play system, depending on the platform you use. The price, currency, applicable taxes and the content offered will be shown before you confirm. Do not complete the purchase if you do not agree with this information.
The transaction is made directly through the store, using your Apple or Google account, and the purchase is tied to the account used to make it. Payment processing, authentication and payment methods follow the platform's conditions. Your store account does not create a MESCLA account. Purchases made by minors must have valid authorization from a parent or guardian and observe the platform's controls.
Access to Full depends on confirmation of a valid purchase. The one-time purchase does not require a new payment for each match. To restore an eligible purchase, use the same Apple or Google account used to make it and the mechanisms available in the app and in the original store, subject to the platform's requirements and device compatibility.
A purchase on the App Store does not automatically grant Full on Google Play, and vice versa. Any additional possibility of sharing or cross-platform use must be expressly stated in the offer.
Refund requests can be submitted through the channels of the store where the purchase was made. You can also contact our support about access or functionality problems. The stores' rules and procedures do not override the mandatory rights of withdrawal, refund, warranty or remedy provided by applicable law, nor Onrizon's responsibilities.
5Children and teenagers
Children under 13 may only use MESCLA with the authorization of at least one parent or legal guardian. For other minors, the rules on representation or assistance by parents or guardians must also be observed where required by law. Parents and guardians should guide participation, oversee purchases and explain that access to a device during a match does not authorize access to that device's private content.
6Proper use and care of devices
Play respectfully and only use devices whose owners have authorized their use. Place the devices on a stable surface and avoid impacts, excessive force or movements that could damage them.
You may not use MESCLA to harass, discriminate against, threaten or embarrass other people; access information or devices without authorization; use cheats or abusive automation; exploit bugs to gain an unfair advantage; or interfere with the security and operation of the app.
Any measures taken to curb abuse must be proportionate to the conduct and respect users' rights. This section does not exclude Onrizon's responsibilities under the law.
7License and intellectual property
You receive a limited, personal and non-exclusive license to install and use MESCLA in accordance with these Terms and the applicable rules of the store that distributes it. Purchasing Full unlocks the features described in the offer; it does not transfer ownership of the app or of its trademarks, code, interface, sounds and other materials.
You may not resell or redistribute the app, remove authorship notices, copy its materials for unauthorized commercial exploitation, or present products and services as officially endorsed by Onrizon without authorization. Uses permitted by law and the licenses of third-party components, where applicable, remain unaffected.
8Availability and changes
The app may experience interruptions, incompatibilities or failures. Updates may fix problems and change features, respecting the purchased offer and users' rights.
We do not guarantee uninterrupted matches, or compatibility with every device and with future versions of operating systems. This does not exclude legal warranties or the obligation to fix the problems we are responsible for.
Changes that substantially affect paid access, or any discontinuation of the service, must be communicated appropriately, with the measures required by law regarding Full purchasers. The one-time purchase is not a promise that the service will operate forever, nor does it allow the arbitrary removal of purchased content.
9Responsibilities and support
Each participant is responsible for their own actions within the limits of the law. Onrizon is responsible for its obligations, for providing the service and for the damages attributable to it, under applicable law.
To report bugs, purchase problems or other situations related to MESCLA, write to team@gartic.com. Do not send store passwords or full payment card details.
10App stores
The App Store and Google Play have their own terms for the distribution, payment and use of their services. Their respective license agreements, where applicable, supplement these Terms.
11Updates to these Terms and governing law
These Terms may be updated to reflect changes in the app or in the law. The current version will be made available with the date it was last updated. Material changes will be communicated clearly and, when necessary, will require your acceptance again. Changes do not affect rights already acquired, nor do they replace privacy choices.
These Terms are governed by Brazilian law, without prejudice to the mandatory user-protection rules of other jurisdictions. Any disputes will be submitted to the competent court, as provided by law, preserving the consumer's right to bring proceedings in the courts where they live, where applicable.
